The Ground Rules

Plain-English terms for using Radically Colorado — what we promise, what we don’t, and what we ask of you.

Template notice: This is a working draft tailored to how Radically Colorado currently operates. A Colorado real estate attorney should review it before you rely on it — in particular the brokerage relationship disclosures, the limitation of liability, and the dispute resolution clauses. Real estate marketing carries state-specific compliance requirements.

1. The Basics

Welcome to Radically Colorado. These Terms of Service (the “Terms”) are a legal agreement between you and Symbio Homes, the licensed Colorado real estate brokerage that operates Radically Colorado. Throughout these Terms, “we,” “us,” and “our” refer to Symbio Homes and Radically Colorado together. “You” means you, the person using the site.

By using radicallycolorado.com, creating an account, signing up for the Colorado guide, watching our videos, or contacting us through the site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the site.

You must be at least 18 years old to create an account or submit your information through the site.

2. Your Account

You can create a free account using your email and a password, or by signing in with Google. When you have an account:

  • Your information needs to be accurate. Don’t use a fake name, someone else’s email, or a phone number you don’t control.
  • Keep your password to yourself. You’re responsible for anything that happens under your account.
  • If you think someone got into your account, tell us right away at derek@symbiodenver.com.
  • One person, one account. Don’t share accounts or sell access to your account.
  • You can close your account any time. Email us, or use the controls in your profile.

3. What We Do

Radically Colorado is a Colorado lifestyle brand. Through the site we:

  • Publish news, articles, and videos about Colorado — neighborhoods, real estate, restaurants, trails, ski resorts, and life at altitude.
  • Offer a free downloadable Colorado guide.
  • Let you sign up so we can stay in touch and so a Symbio Homes agent can follow up if you’re interested in buying or selling a home in Colorado.
  • Embed third-party content (YouTube videos, maps, etc.) where useful.

What we offer through the site is content and the opportunity to connect with us. It is not a contract for real estate services and does not by itself create a brokerage relationship (see Section 4).

4. Real Estate Disclosure

This is important. Visiting Radically Colorado, creating an account, or downloading the guide does not create a real estate brokerage relationship between you and Symbio Homes. In Colorado, a brokerage relationship is only created by a written agreement signed by both you and a Symbio Homes broker.

Until that written agreement is in place:

  • We are not acting as your agent. We do not owe you the duties an agent owes a client (loyalty, confidentiality, advocacy, etc.).
  • If you ask us a real estate question, our answer is general information, not professional advice tailored to your situation.
  • Property information on the site is from sources we believe are reliable but is not guaranteed. Always verify with the listing brokerage and your own inspections.
  • Symbio Homes complies with all federal Fair Housing laws and the Colorado Fair Housing Act. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, sexual orientation, gender identity, marital status, source of income, ancestry, creed, or any other protected class.

If you’re ready to start working with us as your broker, we’ll provide the required Colorado disclosures and a written agreement before we begin.

5. Our Content

Everything on the site — the articles, videos, photos, the Colorado guide, the design, the branding, the code — is owned by Symbio Homes or our licensors and is protected by copyright, trademark, and other laws.

You may:

  • Read articles, watch videos, and download the Colorado guide for your own personal use.
  • Share links to our pages on social media, in emails, or in your own writing.
  • Quote short excerpts with attribution.

You may not:

  • Republish our articles or guide in full on another website, in a newsletter, or anywhere else without our written permission.
  • Use our content to train AI models or for commercial purposes without our written permission.
  • Strip out our branding, watermarks, or author credits.
  • Scrape or harvest the site automatically.

“Radically Colorado,” “Symbio Homes,” and our logos are our trademarks. Don’t use them to imply we endorse or sponsor something we don’t.

6. Your Conduct

While using the site, you agree not to:

  • Break the law.
  • Use the site to harass, defame, or harm anyone.
  • Try to break into our systems, scrape our database, or interfere with other people’s use of the site.
  • Upload viruses, malware, or anything else designed to cause damage.
  • Misrepresent yourself or impersonate someone else.
  • Use our forms to send spam, advertising solicitations, or unrelated commercial pitches.
  • Reverse engineer, decompile, or otherwise try to extract source code from the site.

If you do, we reserve the right to suspend or close your account, block your IP, and pursue any other remedy available to us.

7. Third Parties

The site uses and links to third-party services — YouTube, Google, Meta, Supabase, Squarespace, and others listed in our Privacy Policy. When you use those services through our site, you’re also agreeing to their terms.

The site also links out to other websites — news sources, Colorado businesses we recommend, the Symbio Homes listings site, and so on. We don’t control those sites, we don’t endorse everything on them, and we’re not responsible for their content or practices.

8. Privacy

Our Privacy Policy explains what we collect, how we use it, and your rights. By using the site you agree to that policy, which is part of these Terms.

When you give us your phone number, you’re consenting to calls and texts from us as described in the Privacy Policy. You can opt out any time — reply STOP to texts, or email us to opt out of calls.

9. Disclaimers

We work hard to make Radically Colorado useful and reliable, but we can’t promise the site will be perfect, error-free, or available 100% of the time. The site is provided “as is” and “as available.”

To the maximum extent permitted by law, Symbio Homes disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of content. Information on the site is for general informational purposes only and is not legal, financial, tax, insurance, or professional real estate advice.

Real estate markets, property values, school districts, neighborhood conditions, trail conditions, restaurant openings — all of these change. Information that’s accurate when we publish it may not be accurate later. Verify what matters to you before acting on it.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Symbio Homes, Radically Colorado, or any of our owners, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, lost goodwill, or any other intangible loss — arising out of or related to your use of the site, whether based in contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or your use of the site will not exceed one hundred dollars ($100), or the amount you have paid us in the past twelve months, whichever is greater.

Some jurisdictions don’t allow these limitations. If you live somewhere that doesn’t, the limits apply to the maximum extent permitted in your jurisdiction.

11. Indemnification

If your use of the site causes a problem for someone else — you defame someone in a comment, you violate someone’s rights, you break the law — and that someone makes a claim against us, you agree to defend us, cover our reasonable costs and attorneys’ fees, and hold us harmless from the claim.

12. Termination

You can stop using Radically Colorado any time. To close your account, email derek@symbiodenver.com or use the controls in your profile.

We can also suspend or close your account if we believe you’ve violated these Terms, if your account has been inactive for a long time, or if we decide to discontinue all or part of the site. We’ll usually give notice unless we believe immediate action is needed.

The sections of these Terms that should reasonably survive termination — including our content ownership, the disclaimers, the limitation of liability, the indemnification, and the dispute resolution clauses — will continue to apply after your account is closed.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Real estate matters are also subject to Colorado real estate licensing law and the rules of the Colorado Real Estate Commission.

14. Disputes

If you have a problem with us, please email derek@symbiodenver.com first. Most issues we can sort out in a single conversation, and we’d rather do that than litigate.

If informal resolution doesn’t work, you and Symbio Homes agree that any dispute arising out of or related to these Terms or your use of the site will be resolved exclusively in the state or federal courts located in Denver County, Colorado, and you and we consent to personal jurisdiction in those courts.

You agree that any claim must be brought within one (1) year after it arises, or it’s permanently barred.

Claims must be brought individually. You agree not to bring or participate in any class action, collective action, or representative action against us related to these Terms.

15. Changes

We may update these Terms from time to time. When we make material changes, we’ll update the “Last updated” date at the top of the page and, for significant changes, give you notice by email or a prominent notice on the site. Continued use of the site after the changes take effect means you accept the updated Terms.

If you don’t agree to the updated Terms, your option is to stop using the site and, if you want, close your account.

Everything else

These Terms (together with our Privacy Policy) are the entire agreement between you and us regarding the site. If any part of these Terms is found unenforceable, the rest stays in force. Our failure to enforce any part of these Terms isn’t a waiver of our right to enforce it later. You can’t transfer your rights or obligations under these Terms without our written permission; we can transfer ours as part of a business sale or restructuring.
